Left wing activists know that the British government is prevented from lowering VAT on sanitary products (the tampon tax) by EU law. But that doesn’t stop them using the issue to bash the Evil Tories
From observing the outraged reaction to George Osborne’s 2015 Autumn Statement, you would be forgiven for thinking that the Chancellor was launching his own personal war on women, right from his desk at the Treasury.
By far the most ludicrous criticism of the Conservative government’s updated spending plans was directed at George Osborne’s plan to divert all proceeds raised from the tampon tax to support various women’s charities.
While delivering yesterday’s Autumn Statement, Osborne said:
“We already charge the lowest 5% rate allowable under European law and we’re committed to getting the EU rules changed. Until that happens, I’m going to use the £15m a year raised from the tampon tax to fund women’s health and support charities. The first £5m will be distributed between the Eve Appeal, SafeLives and Women’s Aid and the Haven – and I invite bids from other such good causes.”
A sensible enough idea given the constraints on the Treasury, no?
Wrong.
Cue lots of ostentatious confected outrage and virtue-signalling on social media, with activists and left wing organisations falling over themselves to accuse Osborne of being a heartless misogynist.
Here’s Labour councillor and NHS high priestess Aysha Raza, riding to battle against those awful, sexist Tories:

And lots of other people have been sharing the same Independent article by Holly Baxter, in which Baxter admits that Osborne has no power to abolish the tampon tax but still proceeds to rake him over the coals for trying to help vulnerable women with the resulting tax receipts.
From Baxter’s piece:
Since the Tory government has failed women in so many ways, it makes undeniable sense for it to help us to help ourselves. Give a woman a tampon and she’ll use it for free; teach a woman to pay tampon tax and she won’t even cost anything extra to the state when she gets raped, attacked or laid off at work.
So if you’re a woman escaping from an abusive relationship in the Chancellor’s Britain, you can now pay for your own counselling through the redistribution of an unfair tax on your sanitary products. Isn’t that just perfect? It has a beautiful circularity, kind of like the menstrual cycle itself.
But of course this was never meant to be a rational argument; no, this is just about hating the Tories for the sake of it:
Osborne presumably thinks that women will respond gratefully to his announcement, allowing us to finally enjoy the spoils of our luxury tampon tax. ‘What a noble move!’ we are supposed to cry, while shredding our sanitary towels into confetti and sprinkling them in the streets (don’t worry about the waste – it’s all going to charity, girls.) ‘Women can now collectively take responsibility for the provision of support services to women. Finally, we’re being given the means to sort out the problems we created. This truly is the Big Society.
Back to reality, though, and Osborne almost certainly had zero expectations that his announcement would have women dancing in the streets, but was simply trying to do the best he could with the bad hand he was dealt by the EU. But let’s not let reality get in the way of a good Tory-hating session.
To those on the perpetually-outraged, Tory-hating Left, George Osborne can never do right. It is inconceivable to them that the man who (in their fevered imaginations) falls asleep cackling to himself about driving benefit claimants to suicide might actually want to help women, and use the revenues from a tax that he is forced to levy by Brussels to help truly vulnerable women in our society.
Such an honest motive would shatter the worldview of the Angry Left, who are determined to stick to their two-dimensional caricature of conservative thought and keep their leftist worldview blissfully free of nuance. And so the only reason that George Osborne could be considering using the tampon tax revenues to fund women’s services is either to mock them or to “throw them a bone”.
Is it ludicrous that tampons and pads – an essential item, and about as far from a luxury as it is possible to be – are subject to any VAT? Absolutely. But some on the activist Left are more keen to use this inequity to bash the Evil Tories rather than direct their ire at the source of the problem.
And the problem is their beloved European Union, as the BBC helpfully explains:
A spokesman for HMRC says: “The application of VAT in the EU, including rates and flexibilities afforded to member states such as the UK, is governed by EU law.
“The UK applies a 5% reduced rate of VAT to the supply of sanitary products. This is the lowest rate possible under EU VAT law.”
Yes, the inconvenient truth for the Tory-haters is that VAT on sanitary products is not enforced by the malice of George Osborne, but rather by the dead bureaucratic hand of the European Union.
If these virtue-signalling activists were really so concerned about government discrimination against women, they would spend their time and energies criticising Brussels for not having carved out an exemption long ago.
And if they really wanted to exercise their brains, they could ask themselves whether it is really “democratic” for Britain to belong to a massive supra-national organisation which insists on ever-closer union and harmonisation of vast swathes of policy, making it impossible for the British government to do the right thing and end the tampon tax.
But of course there will be no such introspection from the Left. The EU is benevolent and all wonderful, and nothing bad can possibly come from it. Besides, only swivel-eyed racists and Ukippers would ever criticise the European Union, right?
It’s time for these preening social media activists to decide who and what they really care about. Do they actually want to bring an end to the tampon tax – in which case they should start lobbying Brussels or campaigning for Brexit – or do they simply want to flaunt their virtue by making false allegations of misogyny and chauvinism directed at George Osborne and the Conservatives?
Style or substance – what’s it going to be?

The way British governments set budgets and tweak spending plans is a recipe for bad, short-termist decision making
Forget tax credits for a moment. Forget Right-To-Buy, stamp duty, beer duty and the tampon tax. MPs may still be debating George Osborne’s 2015 Autumn Statement, but step back for a moment and look at the broader picture.
Twice a year – once in the annual Budget and once in the Autumn Statement – the Chancellor of the Exchequer gets to his feet and delivers a refreshed set of economic policies in a big, set piece speech where he is essentially forced to favour tomorrow’s headlines over optimal long or even medium term decision making.
Nationally significant policies from every government ministry live or die by the concessions that their ministers are able to wrangle from a Chancellor who is forced by political reality to be more concerned with tomorrow’s Daily Mail headline than the state of our public finances in a year’s time.
Spending decisions are made based on economic forecasts which are sunnier than a warm day on Venus. Questionable political decisions are defended to the hilt, because to question them in light of new data would be to commit the gravest of self-inflicted political wounds, the U-turn. The government of the day rolls out a “smoke and mirrors” act worthy of David Blaine, and all to glam up the fact that they have slightly re-arranged the deckchairs on the Titanic.
And for what? To draw the public in to the political process? To high-mindedly arbitrate complex questions of economic policy? To astutely position Britain vis-à-vis our global competitors, ensuring that our tax code, infrastructure and labour market are the most attractive in the world?
No. We do it just so that the government of the day – or a nimble opposition (remember those?) – can score political points. And, of course, because it is traditional.
Some traditions – like MPs not clapping in the Commons chamber – are antiquated and affected, but do little real damage. Others – like MPs having to leave the Commons chamber through a specific door in order to vote, rather than availing themselves of fast electronic voting technology – are an irritant, a brake on the smooth running of our legislature.
But some traditions belong in another category – things that do real, actual harm, not just to the running of our Parliament but to the political outcomes which we then have to live with every day. Some traditions actively harm our democracy.
I would submit that the Budget and Autumn State set-piece theatre events fall into this latter category. Politically astute chancellors (like George Osborne on a good day) may relish them because they provide an unparalleled opportunity to draw red lines and create traps for the opposition. The Westminster media may like the status quo, because if nothing else, these events can be moments of real political drama.

But besides savvy chancellors and the established media, it is hard to tell who else benefits from the current system other than the cause of Big Government.
Having two occasions each year when an already-powerful chancellor like George Osborne in an already-centralised country like the United Kingdom gets to play with nearly all of the controls and levers which influence our economy – as though he were Homer Simpson at the controls of Springfield Nuclear Plant – only encourages meddling and tweaking of things that should properly be left to local government and individuals.
When you have direct, ultimate control over which families deserve help buying a house, which people should keep or lose their benefits or how much a person pays in sin taxes for their guilty pleasure, the temptation to use those powers is irresistible. And because of the ratchet effect, it is the easiest thing in the world to give away new perks to favoured interest groups, but nearly impossible to ever claw them back without being exposed to political attack. Even under this nominally conservative government, budgets and autumn statements have often been a one-way ticket to bigger government – or at least more activist state.
No system is perfect. One needs only look across the Atlantic ocean at the United States, with their unseemly debt ceiling fights and government shutdowns (oh, to have one here) to realise that you do not need a Westminster parliamentary-style system to sow budget chaos. But the flaws in our current system are obvious, and have been staring us in the face for years – yet nobody has proposed the slightest alteration, choosing instead to cheer when their side “wins” and whine when the other side is in power and sets a budget with which we disagree.
People did not elect a Conservative government only to have George Osborne sit at the control console of their lives, Homer Simpson-like, flicking switches and adjusting dials here and there in order to manipulate our mood so that we vote Tory again in 2020. If conservatism still means anything, it should mean a healthy scepticism of the state and its power to influence or police human behaviour.
Surely at some point our desire for smaller government and a smarter state has to outweigh our devotion to the dusty tradition of a man standing on the doorstep of his house, waving a red box around.

Today’s virtue-signalling, totalitarian student activists will stop at nothing to let everyone know just how enlightened and considerate they think they are, and how backward and oppressive they consider the rest of us to be
If you haven’t heard the term “cultural appropriation” before, you can expect to hear it a lot over the next few years. And if you have the misfortune of living anywhere near a university campus, you may even hear it shouted in your face by a raucous student protester, high on their own self-importance.
In fact, even if you’re not committing the modern day sin of cultural appropriation right now, you are almost certainly guilty of doing it at some point over the past twenty-four hours. Go and do your penance now. I’ll wait.
Cultural appropriation is the latest verbal weapon used by virtue-signalling lefty student activists – snivelling Millennial egotists who arrived at university only to find the worst oppression and discrimination already vanquished by previous generations, and who are now desperately casting around for a new cause to justify their Chinese-manufactured Che Guevara t-shirts.
Let’s put it like this: are you a white person who likes rap music, or who (heaven forfend) listens to music by white rappers from Eminem to Iggy Azelea? Then you’re a white supremacist cultural appropriator. By appreciating or assimilating something from outside of your own ethnic community, you have plundered the culture of your downtrodden minority friends and neighbours, making light of their most sacred and noble traditions for your own carefree amusement. Didn’t realise that’s what you were doing? Doesn’t matter, you’re still guilty.
Or maybe you really fell in love with Thai cuisine when you were on that round-the-world trip, and now you love to cook Thai-inspired meals at home, with your non-Thai hands, in your non-Thai kitchen, for your non-Thai friends. That’s cultural appropriation too. Shame on you. If you are a white American you should subsist entirely on cheeseburgers, barbecue and other culturally appropriate fare. God help you if you’re a Cockney but not mad for jellied eels.
Stay away from that lasagne if you’re from Idaho or Utah – can’t you see how eating pasta belittles and marginalises Italian Americans? And as for ordering Kung Pao chicken from your favourite Chinese takeout, why don’t you just start reading aloud from Mein Kampf in the town square, you nasty little fascist? Clearly you have no feeling for the mental safety of Asian Americans, who might feel mocked and excluded by your thoughtless foodcrime.
You get the idea. Before doing anything, first get out your Hierarchy of Privilege and remind yourself exactly where you fit on the Spectrum of Oppression. White and male? Tough luck, you can sample only from those other white, male cultural pursuits. Black, disabled and of undefined gender and sexuality? Then the world is your oyster – at least in the surreal world of academia.

And now the Stepford Students are coming to take away your Yoga classes, because chances are you aren’t from India – and therefore you are guilty of the cultural appropriation of Indian culture.
From Brendan O’Neill’s weary report in The Spectator:
Just when you thought uptight, fun-dodging, thought-policing millennials couldn’t get any worse, they go and brand yoga as racist. Apparently, when white people bend themselves bonkers while humming or thinking happy-clappy thoughts, they’re not only being self-punishing saps: they are also ‘culturally appropriating’ a practice that has ‘roots in Indian culture’.
That’s according to student leaders at the University of Ottawa, who put pressure on a yoga teacher at the uni’s Centre for Students with Disabilities to call off her yoga classes. She was told ‘there are cultural issues of implication involved in the practice’. In these people’s minds, in which the Offence-Seeking Antenna is forever turned to High, a white person doing yoga is not that different to a white person donning blackface and singing ‘Mammy’.
O’Neill goes on to point out:
The PC rage against cultural appropriation is ultimately a demand for cultural segregation, for black people, white people, Latinos, gay people, women and every other racial, gender or sexual group to stick with their own culture and people and not allow themselves to be diluted by outsiders.
Gay men have been condemned by the National Union of Students for ‘appropriating black female culture’. Barmy NUS officials think it’s the height of racism for a gay guy to talk about having an ‘inner black woman’. The irony being that it’s hard to think of anything more racist, or at least racially divisive, than the ideology of cultural appropriation: its obsession with cultural purity echoes some of the darkest political movements of the twentieth century.
It’s easy to dismiss these incidents as merely a case of a few activists getting a bit too carried away, or going a bit too far. But incidents such as these are happening more and more often, on both sides of the Atlantic.
Whether it is British students shutting down a debate about abortion and trying to get Germaine Greer banned from campus, or pampered Yale students insisting that the point of university is not to learn but rather to feel warm and snuggly, these stories are becoming more extreme, more frequent and ever more ludicrous to the uninitiated.
This is in large part because the authorities – university chancellors, society presidents and anyone else called upon to be an auxiliary parent to these toddlers-with-diplomas – too often reward this hysterical behaviour by apologising for offending the Stepford Students and giving in to every one of their tyrannical demands. Which then encourages the next crop of baby-faced tyrants to make even more outrageous demands in the name of creating a “safe space”.
With their accusations of “cultural appropriation” and unquestioning embrace of the politics of identity, these student activists are starting to create a New Apartheid – on their university campuses and in their hermetically sealed social circles of likeminded social justice warriors. Their overriding concern with protecting the “purity” of various minority cultures resembles nothing so much as the anti-miscegenation laws of the last century. And all of this they do without a hint of irony.
These students are nothing so much as High Priests of the Politics of Identity. Like other clergy before them, they derive their power from claiming the exclusive ability to speak on behalf of their secular god and telling the rest of us what we must believe and say. But in place of stoning or crucifixion being the penalty for blasphemy we now have new, modern shamings carried out on social media.
In a famous scene from Aaron Sorkin’s show The Newsroom, the lead character described the American Tea Party – with their intolerance of dissent and insistence on ideological purity – as being like an American Taliban. But I wonder if the real progressive Taliban can’t actually be found on our university campuses, in our student union bars and in the front row of your nearest anti-austerity rally, shouting “Tory Scum!” at terrified old ladies.
If we let these fragile young tyrants win, we will eventually all be ghettoised, forced to keep strictly to our own “communities” (community being defined strictly by racial or religious criteria) and only allowed to engage with other people in the controlled environment of “safe spaces“, where our speech and behaviour is micromanaged to ensure that we do not “trigger” anybody else with the problematic “microaggression” of our mere presence.
Yes, there is a dangerous radicalisation process taking place on our university campuses today. But deluded young radicals are not only rallying to the black flag of ISIS – we should also mark those who drink so deep from the well of Social Justice that they would make us all slaves to their cause.

No, Andrew Neil’s magnificent anti-Islamist rant was not a violation of the BBC’s commitment to impartiality
It’s a strange world where I find myself writing in support of Andrew Neil twice in the same week, but then these are very strange political times.
Nick Cohen sings Andrew Neil’s praises in The Spectator this week, before going on to condemn Neil’s rousing anti-ISIS monologue at the start of his This Week programme – a speech which this blog strongly supported – on the puzzling grounds that it broke the rules on journalistic impartiality.
Cohen writes well as always, but there are so many mistaken premises and inaccurate comparisons in this piece that a proper rebuttal is needed.
His criticism of Neil begins:
Everywhere you look you can see broadcasters following Neil and Snow and pushing against the fuddy-duddy rule that they must show ‘due impartiality’. The Church of England is joining in, and pushing against equally antiquated restrictions on political and religious advertising.
They must be stopped. However admirable Neil and Snow’s sentiments are, and however inoffensive the Anglican’s celebration of the Lord’s Prayer was, we have to shut them up. The BBC and Channel 4 should never have broadcast their interviewers’ opinion. The cinema chains were right to tell the Church of England it was not welcome on their screens.
Britain is a country with rules to prevent wealthy politicians buying votes and wealthy televangelists buying converts. We are also a country that has fought to maintain the principle that broadcasters must be politically neutral – not always successfully, I grant you.
Three points here. First, the requirement for broadcasters to show ‘due impartiality’ applies to news programmes, and not to commentary – least of all when we are nowhere near a general or local election, the time when the rules governing broadcaster impartiality are at their strictest. The BBC’s This Week is a political magazine show, not a straight-laced news bulletin. Of course one would not expect Evan Davis, Kirsty Wark or Huw Edwards to pepper their delivery of the news with caustic criticisms or sarcastic asides – that would be highly improper. But a political magazine show is by definition an opinion-based show, relying for its content on a parade of partisan guests from different political parties and the media.
Cohen attempts to lump Andrew Neil’s tirade against ISIS along with Jon Snow’s coverage of the Israeli siege of Gaza, but this is comparing apples and oranges – one is a daily news bulletin required to be impartial, and one is a weekly talk show where opinions and partisan debate are essential ingredients.
Second, this is Andrew Neil we are talking about – a seasoned veteran journalist and businessman with a vast political Rolodex and a personal “brand” all of his own. Neil was also editor of the right-leaning Sunday Times for over a decade, is chairman of the company which owns the reliably Tory-friendly Spectator, and in previous life was a researcher for the Conservative Party. Neil was never supposed to be an anonymous newsreader, nor is he marketed as one – people watch This Week because Andrew Neil presents the show, and they know exactly what they are getting when they do so. The BBC are fine with that, and there is nothing to suggest that either the letter or the spirit of the rules are not being followed.
And thirdly, while Cohen’s assertion that Britain is “a country with rules to prevent … wealthy televangelists buying converts” might plausibly be true, we are also a nation with an established state Church – one whose grasping tentacles reach into nearly aspect of our politics and our national life. The ongoing row about the Church of England’s cinema advert is a separate issue, but we should not pretend that our United Kingdom is a nation where we even pay proper lip service to the concept of separation of powers.
When meddlesome bishops speak out in parliamentary debates without a shred of a democratic mandate, and when there are still scenarios whereby the Queen might conceivably end up picking the next government, we should not act as though there is some ancient and grave constitutional requirement for television stations to broadcast opinionless, equivocating platitudes 24/7.

Cohen continues:
Broadcasters themselves know a dirty secret newspaper editors understand too well: extreme opinions sell. They confirm the partisan in their beliefs and draw in outraged opponents.
[..] Broadcasters want a piece of that action. Opinion is cheap. News is expensive. The public watched Andrew Neil and Jon Snow’s polemics in their millions. What possible justification is there for insisting on balance, accuracy and impartiality?
It may be the case that news is expensive while opinion is cheap, but without the forceful expression of political opinions there could be no This Week in the first place – indeed, there could be no Question Time or Newsnight interviews either, let alone the crucible that is Radio Four’s Today Programme. And if Cohen is saying that the host should always be impartial even on political magazine shows then he sets a standard which can simply never be met, since every raised eyebrow, incredulous glance, rude interruption or “gotcha moment” will be seized on as evidence of deepest bias. Far better that we have good presenters with transparent histories like Neil, and then allow the public to adjust their perceptions accordingly.
Besides, this is not a question of political neutrality, at least as we traditionally understand the matter. Britain is not at war with a sovereign nation, however much ISIS may try to strut and pose as such. We are in conflict with a nihilistic, totalitarian death cult which seeks to spill the blood of everyone who does not adhere to their harsh, warped interpretation of Islam. They stand for nothing save creating hell on Earth to please their petty, jealous and vindictive god. Why shouldn’t the presenter of a serious political talk show be able to say that which we all know to be true?
And since when did expressing an opinion prevent something from being “real journalism”? Is Cohen himself not a journalist because his Spectator piece failed to strike an impartial position between Andrew Neil and himself? Whenever a broadcast news presenter reports on a “horrifying murder” or a “tragic death” they are making a value judgement and presuming to speak on behalf of the 99.5 percent of people who will agree with them. There is no moral or statutory requirement for the newsreader to treat criminal and victim alike in their tone and description, nor should there be. Similarly, ISIS are torturers, rapists and murderers. They break the law every moment of every day in their campaign to spread hatred and ignorance around the world. What’s wrong with saying so?
If ISIS were a legitimate, functioning state or political party and Andrew Neil went on a two minute tirade about their fiscal policy or industrial strategy then there might be grounds to accuse him of political bias. But that is absolutely not the case. Andrew Neil saw ISIS (or Islamist Scum, as he now calls them) take their patented formula of death and suffering, and smear it across the bright lights of Paris one unsuspecting Friday night, and he called it what it was – an act of savage murder that history suggests is doomed to fail in its stated goals.
If ISIS supporters were greatly offended by Neil’s words and lack of objectivity then by all means they can submit a complaint via OFCOM or the BBC Trust. I rather hope that they try.
But they do not need Nick Cohen – or anyone else – to help them out.
